1Introduction, Eligibility & Acceptance
This Agreement (“Terms”, “Terms and Conditions”) is entered into between you or the entity you represent (“You”, “User”, “Client”) and Rohit Vishwakarma (operating professionally under developer entities including DevelopeOne Apps / developeoneapps, referred to as “Engineer”, “I”, “me”, or “we”).
These Terms govern your access to:
- This developer portfolio website.
- Software products and mobile applications (Android/iOS) published under DevelopeOne Apps on Google Play Store or digital marketplaces.
- Custom mobile app engineering, full-stack architecture, consulting, and AI-accelerated development services.
- Online invoice payments and digital service transactions.
Age of Majority: You must be at least 18 years of age (or the age of majority in your jurisdiction) and legally authorized to enter into contracts to accept these Terms. If you do not agree, please discontinue access immediately.
2Services & Products Covered
Mobile Apps & Sub-Products
Native Android and cross-platform Flutter utility apps published on app stores, offered under free, paid, or subscription licenses.
Custom Engineering Engagements
Bespoke mobile applications, AI agent integration, full-stack systems, backend APIs, and VPS deployments built under formal Statements of Work (SOW).
Where a specific client contract, SOW, or in-app end-user license agreement (EULA) exists, the specific terms of that signed contract take precedence over these general guidelines in case of direct conflict.
3Account Credentials & Responsibilities
If an application or client portal provides user authentication or dashboard access:
- You are responsible for maintaining the confidentiality of your login credentials and passwords.
- You agree to provide true, accurate, and current information during registration.
- You must notify us immediately at developeoneapps@gmail.com of any suspected unauthorized access or security breach.
- We reserve the right to suspend accounts that provide fraudulent information or violate security protocols.
4License Grant & Acceptable Use
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access our published applications for their intended purposes.
- You shall not reverse engineer, decompile, or disassemble any binary or compiled APK/AAB package, except where permitted by mandatory law.
- You shall not resell, sublicense, rent, or lease any application or proprietary software deliverable without prior written consent.
- You shall not introduce viruses, malicious scripts, or attempt unauthorized penetration testing against our systems or servers.
- You shall not remove or obscure any copyright notices, watermarks, or trademark branding.
5Intellectual Property & Code Ownership
For custom engineering engagements, all custom-written application source code, bespoke algorithms, and project assets belong 100% to the Client upon full payment of agreed milestone invoices.
Pre-Existing Frameworks & Developer Tools: The Engineer retains all ownership in general reusable utilities, open-source libraries, template boilerplates, and developer tooling developed independently prior to or outside the custom engagement. The Client receives an irrevocable, royalty-free, perpetual license to utilize these integrated components as part of their delivered software.
User Content: You retain all intellectual property rights to data, files, and content you upload into our applications. We make no ownership claim over your business or personal records.
6Invoicing, Payment Gateways & Taxes
- Secure Gateway Processing: Payments are processed via authorized, PCI-DSS compliant third-party gateways (Stripe, Google Play Billing, or direct wire). We do not store credit card numbers, UPI PINs, or banking passwords.
- Invoicing Timelines: Client engineering invoices are payable within the terms specified on the invoice (default: 15 business days). Ongoing work or staging access may be paused for overdue accounts.
- Taxes: Fees are exclusive of applicable government levies, GST, or transaction fees unless explicitly stated otherwise.
- Chargebacks: In the event of an unjustified chargeback, we reserve the right to suspend account access and pursue recovery of outstanding amounts and processing costs.
7Subscriptions & Mobile App Purchases
For digital sub-products and mobile apps operating on subscription or paid models:
- Billing Cycle: Recurring subscriptions are billed at the interval selected during signup (monthly or annually).
- Management & Cancellation: Subscriptions can be cancelled at any time through the Google Play Store (or respective marketplace) subscription manager. Cancellation stops renewal for the subsequent period.
- Refunds: Governed by our dedicated Refund Policy (paid downloads are non-refundable; subscriptions follow in-app declaration terms).
8Post-Launch Engineering Warranty
Completed custom engineering engagements include a complimentary 14 to 30-day bug-fix warranty period following production handover:
During this window, any defects or discrepancies against the agreed Statement of Work are diagnosed and corrected free of charge. Out-of-scope feature additions or third-party API breaking changes are billed separately.
9Disclaimer of Warranties (“As-Is”)
Except as expressly set forth in a signed Statement of Work, our website, published mobile applications, and services are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, uninterrupted uptime, and non-infringement.
While we practice industry-standard technical methodologies to safeguard your data and applications, no digital transmission or electronic storage system is 100% impenetrable. We do not claim or warrant 100% absolute data security, and access is utilized at your own discretion.
10Limitation of Liability
To the maximum extent permitted by applicable law, the cumulative liability of the Engineer arising out of or related to these Terms, the website, applications, or services shall not exceed the total fees paid by you for the specific project milestone or product purchase in dispute during the preceding 3 months. In no event shall we be liable for indirect, incidental, punitive, or consequential damages.
11Indemnification
You agree to defend, indemnify, and hold harmless Rohit Vishwakarma and associated affiliates against any third-party claims, liabilities, damages, and legal costs arising from: (a) your misuse of our applications or services; (b) client-provided content, logos, or assets that infringe on third-party intellectual property; or (c) your breach of these Terms.
12Termination & Survival
We reserve the right to suspend or terminate your access to any application or service for material breach of these Terms, non-payment, or fraudulent activity. Upon termination, provisions regarding Intellectual Property, Confidentiality, Disclaimers, Limitation of Liability, and Indemnification shall survive.
13Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Both parties agree to first attempt resolution of any dispute through good-faith mutual consultation. Subject to any arbitration agreement in a signed SOW, courts in India shall have jurisdiction over legal disputes arising under these Terms.
